This document was prepared to support launch of the Kostiak Green platform and is not a substitute for legal advice from a licensed attorney. Sections marked [BRACKETED] require a decision from the company before this document is considered final.

1. Purpose

This Acceptable Use Policy ("AUP") describes what you may and may not do with the Kostiak Green platform, our Derived Metrics, and any data, reports, or exports you access through your subscription. It applies to all plans — Local, Professional, and Corporate — and is incorporated into our Terms of Service by reference. If anything here conflicts with the Terms, the Terms control.

2. The one rule that applies to every plan

Every Kostiak Green subscription, regardless of tier, is licensed strictly for the internal business use of the subscribing entity. No plan permits reselling, redistributing, sublicensing, or otherwise making available our data, Derived Metrics, scores, reports, or exports to any third party — including other dispensaries, brands, consultants, investors' other portfolio companies, or any business not directly owned and operated by the subscribing entity — whether for payment or for free.

3. General prohibited uses

Regardless of plan, you may not use the Platform to:

(a) resell, license, rent, lease, or otherwise distribute the Platform or any data, score, or output derived from it to a third party;

(b) build, train, or commercially operate a product or service that competes with Kostiak Green, using data or methodology obtained from the Platform;

(c) use automated scripts, bots, or scrapers to extract data from the Platform beyond the normal, authorized use of your dashboard and any API included in your plan;

(d) attempt to reverse-engineer, decompile, or derive the underlying methodology of our normalization, scoring, or genetic-lineage engines;

(e) misrepresent your business identity or share login credentials beyond your plan's authorized seat allowance; or

(f) use the Platform in a way that violates applicable law, including cannabis-licensing regulations in your jurisdiction.

Tier-specific terms

Local

Single-location team access

  • Use limited to one (1) business location and its own internal pricing and inventory decisions.
  • Dashboards, alerts, and the Pricing Health may be viewed and used internally by your team only.
  • No resale, redistribution, or sharing of Platform data, scores, or exports with any third party, including other dispensaries, brokers, or consultants not employed by your business.

Professional

$299/mo

Up to 5 team members

  • Use limited to state-wide competitive data for your own business and up to 5 named team-member accounts.
  • Genetic Intelligence, gap-radar, and benchmarking outputs may be used internally for your own assortment, pricing, and purchasing decisions only.
  • No resale, redistribution, or sharing of Platform data, scores, or exports with any third party, including brands, distributors, or other operators, even informally or at no charge.
  • Additional team members beyond the plan's 5-seat allowance require an upgrade to Corporate or a separate agreement with us.

Corporate

$799/mo

Multi-location / multi-state team access

  • Use limited to the subscribing entity's own locations, brands, and internal multi-state operations.
  • API access and data exports provided under this plan may only be consumed by your own internal systems and personnel (or contractors bound by confidentiality obligations equivalent to this policy) — never piped into a product, dashboard, or feed offered to any third party, including a client, portfolio company, or investor's other portfolio companies, without our prior written consent.
  • No resale, white-labeling, sublicensing, or redistribution of Platform data, scores, or exports to any third party.
  • Investors and multi-brand operators with a genuine need to share aggregated insights across affiliated entities they directly own or control should contact us — case-by-case written permission, not assumed.

4. Enforcement

Violation of this AUP is a violation of our Terms of Service and may result in suspension or termination of your account, with or without notice. We may also pursue any other remedy available to us at law or in equity, including injunctive relief, where redistribution of our Derived Metrics or methodology causes us harm.

5. Requesting an exception

If your business has a legitimate need that falls outside these restrictions — for example, sharing aggregated insights across affiliated entities you directly own and control — contact us at hello@kostiak.pro before doing so. Exceptions require our prior written consent and are evaluated case by case.

6. Changes to this policy

We may update this AUP from time to time, consistent with the change process described in our Terms of Service.
